These terms apply to Modular Solar Arch kits, parts and services ordered from Yacht Solar Arches. Back to the Modular Solar Arch

1. About us

1.1 Yacht Solar Arches is owned by Latbros Ltd, registered in England and Wales (company number 11994827, VAT number 326072619). Latbros Ltd is the billing entity for all orders.

1.2 Trading address: Latbros Ltd, Mill Rythe Lane, Hayling Island, PO11 0QQ. Telephone: +44 23 9400 8764. Email: info@yachtsolararches.co.uk.

1.3 In these terms, "we", "us" and "our" mean Latbros Ltd trading as Yacht Solar Arches. "You" means the customer placing the order.

2. These terms

2.1 These terms apply to every Modular Solar Arch kit, additional part and service (assembly, installation, panel fitting, packaging and delivery) we supply.

2.2 Specific terms in your formal quote or order confirmation apply in addition to these terms. If they conflict, the specific written agreement takes priority.

2.3 If you are buying as a consumer, nothing in these terms affects your statutory rights, including under the Consumer Rights Act 2015.

3. Prices, quotes and VAT

3.1 All prices are shown excluding VAT. VAT is added at the current rate.

3.2 Prices on our website are a guide. The price you pay is the price in your formal quote. Formal quotes are valid for 7 days unless stated otherwise.

3.3 Installation prices are preliminary. The standard installation price covers boats within 25 miles of our Hayling Island workshop. We confirm the final cost after a boat survey or once we have full details of your boat. Further locations, limited internal access or extra work may increase the cost.

3.4 Delivery is quoted separately and depends on arch size, packaging and destination.

3.5 If we make an obvious error in a price, we will tell you before fabrication and you may confirm the corrected price or cancel without charge.

4. Placing an order

4.1 Submitting a quote request on our website is an enquiry, not an order. We review your request and send you a formal quote.

4.2 A contract is formed when you accept our formal quote and we send you an order confirmation.

4.3 We may decline an order, for example if the arch is not suitable for your boat or we cannot confirm the required information. If we decline, we refund anything you have paid.

5. Your measurements

5.1 You are responsible for providing accurate and complete measurements, in millimetres, between the centres of the relevant fitting points. We fabricate to the dimensions and specifications you supply and confirm.

5.2 Because of the easy-fit design, measurements are accepted within a tolerance of ±10 mm. Frames are normally made at least 100 mm wider than the supplied width to allow adjustment and installation tension.

5.3 Where needed, measurements should be checked by a suitably competent person before fabrication. We may ask you to clarify or confirm measurements before we start.

5.4 We are not responsible for fitment problems, alterations, extra costs or delays caused by inaccurate, incomplete or incorrectly interpreted measurements you supply.

6. Approval before fabrication

6.1 Before fabrication, you must review and approve the final measurements, size, lean-back angle, finish, fittings, accessories and options.

6.2 Proceeding with the order confirms you accept the supplied information and these terms. Approving a drawing or quote does not transfer responsibility for the measurements you supplied.

7. Payment and ownership

7.1 Unless agreed otherwise in writing, payment in full is due before fabrication begins.

7.2 Any additional work, parts, design changes or delivery charges not in the original quote must be approved and paid for before we carry them out.

7.3 Where installation is paid separately, the installation balance is due on completion unless agreed otherwise.

7.4 Ownership of the goods passes to you once we have received full payment.

8. Fabrication and dispatch times

8.1 Fabrication normally begins within 48 hours of order confirmation, once we have received all measurements, design information, approvals and payment.

8.2 Dispatch is typically 3–4 weeks for UK orders and 4–6 weeks for worldwide orders from order confirmation. These times are estimates.

8.3 Times may be affected by fabrication, polishing, packaging, carrier delays, weather or other circumstances outside our reasonable control. We will tell you promptly about any significant delay.

9. Changes and cancellation

9.1 Changes to the design, measurements, finish, fittings or accessories must be agreed in writing before fabrication begins.

9.2 Changes requested after fabrication has started may not be possible. Where they are, you pay for any extra materials, labour, finishing, transport or other associated costs.

9.3 You may cancel before fabrication starts by emailing info@yachtsolararches.co.uk. We refund your payment, less any reasonable costs already incurred specifically for your order.

9.4 Once fabrication has started, the order cannot be cancelled. Each arch is made to your specification, so the 14-day cancellation right under the Consumer Contracts Regulations 2013 does not apply to made-to-order goods.

9.5 If you cancel an installation booking with less than 48 hours' notice, we may charge for any travel and time already committed.

10. Delivery, collection and risk

10.1 Collection from our workshop is free. You are responsible for bringing a suitable vehicle, securing the arch safely and protecting the polished finish in transit.

10.2 Delivery is available at extra cost. You must provide an accurate delivery address and make sure someone can receive the goods.

10.3 Please inspect the packaging and arch on arrival. Photograph any transport damage and report it to us and the carrier within 48 hours. Note any visible damage on the carrier's delivery record.

10.4 For deliveries outside the UK, you are responsible for import duties, local taxes, customs charges and any delays caused by customs.

10.5 Risk in the goods passes to you on collection or delivery. Once delivered or collected, you are responsible for storing the arch safely.

11. Installation by our engineers

11.1 Installation includes riveted assembly (unless specified otherwise), fixing and sealing the arch at the agreed fitting locations, and fitting any bracing you have ordered.

11.2 You must provide safe access to the boat and to the inside of the hull behind the fitting points, any marina or yard permissions, and shore power where needed. Lockers should be emptied and equipment cleared from the work area.

11.3 You authorise us to drill the deck and structure at the agreed fitting locations. We agree these locations with you before drilling.

11.4 If internal access is limited, if existing equipment must be removed or refitted, or if we find hidden issues such as a wet or damaged deck core, we will tell you before doing extra work. Extra work is charged as agreed.

11.5 We are not responsible for pre-existing defects in your boat, its deck, core or wiring, or for delays caused by weather, tides or access restrictions.

11.6 Electrical connection of solar panels, controllers and batteries is not included unless stated in your quote, and should be carried out by a suitably qualified person.

12. Self-installation and suitability

12.1 If you install the arch yourself or use another installer, you are responsible for confirming that the boat, deck, mounting locations and supporting structure are suitable.

12.2 You or your installer must check access, clearances, obstructions, equipment positions and deck construction before installation, and follow our written instructions and video guide.

12.3 Final drilling of the swivel fitting connectors is your responsibility. The kit includes 12 × M8 × 60 mm deck bolts; you must check they suit your deck thickness and supply longer bolts if needed.

12.4 Any modification to your boat must be carried out by you or a suitably competent installer.

13. Additional parts and work

13.1 Additional bracing, brackets, fittings, instrument supports and modifications are not included unless stated in your quote or order confirmation.

13.2 Larger arches usually need extra bracing. We will advise what your boat needs, but the final choice of parts ordered is yours.

13.3 Additional parts must be compatible with your arch and boat. We may ask for further measurements or photos before confirming compatibility.

14. Safe use and loads

14.1 The arch is designed to carry solar panels and the brackets and equipment we supply or approve.

14.2 Do not use the arch, lifting eyes or brackets for loads beyond those we advise, as a handhold, boarding aid or person support, or to lift a tender or outboard, unless we have confirmed in writing that your configuration is designed for it.

14.3 Check fixings, bolts and bracing regularly, especially after heavy weather, and tighten or replace them as needed.

15. Finish and care

15.1 Polished 316 stainless steel may show minor cosmetic variations, polishing marks and differences between mirror and satin fittings. These are not defects.

15.2 In a marine environment, stainless steel can develop light surface staining ("tea staining"). Rinse the arch with fresh water and clean it regularly with a suitable stainless-steel cleaner. Surface staining is not a defect.

15.3 Protect the finish when handling, cutting, drilling and installing the arch.

16. Guarantee and defects

16.1 We guarantee our fabrication and workmanship against manufacturing defects for 12 months from delivery or collection. This is in addition to your statutory rights.

16.2 Please report any defect as soon as reasonably possible, with photographs, measurements and other relevant details. We may ask to inspect the arch.

16.3 If we confirm a defect caused by us, we will repair or replace the affected part, or refund its price where repair or replacement is not possible.

16.4 The guarantee does not cover damage caused by handling, transport after delivery, incorrect installation, modification, accident, overloading, unsuitable storage, lack of maintenance, normal wear, or inaccurate measurements you supplied.

17. Returns

17.1 Each arch is cut, fabricated and finished to your measurements, so returns are not accepted once fabrication has started, except for significant engineering or manufacturing errors attributable to us, or where the law requires.

17.2 Unused standard additional parts (not made to your measurements) may be returned within 14 days of delivery in their original condition and packaging. You pay the return postage.

18. Liability

18.1 To the extent permitted by law, we are not responsible for damage, loss or extra costs resulting from inaccurate measurements, unsuitable deck structures, incorrect installation by others, unauthorised modifications, inadequate fixings, improper handling, overloading or failure to follow installation and care instructions.

18.2 We are not responsible for solar panels, electrical equipment or other items not supplied by us.

18.3 If you are a business customer, we are not liable for loss of profit, loss of use of the boat or any indirect loss, and our total liability is limited to the price paid for the order.

18.4 Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

19. Events outside our control

19.1 We are not responsible for delays or failure to perform caused by events outside our reasonable control, such as severe weather, supplier or carrier failures, material shortages, illness or strikes. We will tell you as soon as possible and agree a new date. If the delay is significant, you may cancel and receive a refund for anything not yet supplied.

20. Designs, photos and data

20.1 Our designs, drawings, instructions, videos and photographs remain our intellectual property and may not be copied or used to make arches without our permission.

20.2 We may photograph completed arches for our portfolio and marketing. We will not show your boat name or personal details without your agreement. Tell us if you prefer we don't use photos of your boat.

20.3 We use your personal details only to handle your enquiry and order, as set out in our Privacy Policy.

21. Complaints and law

21.1 If you have a problem, please contact us first at info@yachtsolararches.co.uk or +44 23 9400 8764. We aim to respond within 5 days.

21.2 These terms are governed by the law of England and Wales. Consumers living elsewhere in the UK may also bring proceedings in their local courts.
